Terms and Conditions

I- The access and use of the websites and APPS owned by CASA BARRÉ, (JAVALAMBRE INVESTMENTS S.L.) (from now on, "CASA BARRÉ") with CIF B42953984 and registered office at Calle Ayala 71, 28001, Madrid and registered in the Mercantile Registry of Madrid, volume 41507, folio 204, entry 1, with page M735512, whose web addresses are www.casabarre.com.

II- The on-line social media opened in the name of CASA BARRÉ (among others, Facebook, Instagram, twitter, Spotify, Tik Tok, Vimeo, Youtube, etc.), (hereinafter, "the social media")

III- The conditions of use of the services offered by CASA BARRÉ in its premises, (hereinafter "."("Studio

IV- The purchase/sale of products related to CASA BARRÉ.

V- The conditions of use of the services offered by CASA BARRÉ online.

The access to the Websites implies the acceptance of these Terms and Conditions, as well as the different modifications and/or additional legal texts that CASA BARRÉ may include in the future.

Interaction through social media implies acceptance of these terms and conditions.

The purchase of products and services offered by CASA BARRÉ either through the present webs, APPS, by telephone or in person in one of the Studios in which CASA BARRÉ operates its activity and the use of the services that CASA BARRÉ offers in its Studios and in its platforms imply the acceptance of the present terms and conditions.

The present terms and conditions are available to users of the websites, apps and customers both on the website, in the APP and physically in the Studios.

1.- Access to Websites and APPS.

The present Websites and APPS owned by CASA BARRÉ have been developed by CASA BARRÉ with the purpose of offering information and sales about the products offered and services provided by CASA BARRÉ. These services consist of the provision by a trainer of collective physical activity classes in the Studios and the availability of pre-recorded classes and online classes and APP.

2.- Functioning of the Web Sites and Customer Account.

Through the Websites and APP customers will have the possibility to:

I.Fill in the Registration form to become a client of CASA BARRÉ.

II. Purchase individual classes and/or monthly packages, with the possibility of recurring subscription for one year.

III. To carry out online reservations and cancellations of places in Studio classes.

IV. To acquire products related to the CASA BARRÉ brand.

V. Make outstanding payments related to classes in the Studios.

VI. Purchase monthly voucher for online sessions.

VII. Cancel recurring subscriptions.

VIII.All Users/Customers regardless of whether they are registered online or not, accept the present terms and conditions; any Guest to try a class has been informed of the present terms and conditions.

However, in order to enjoy the services that CASA BARRÉ offers, the Clients must create an account either in person at the Studio through the staff of CASA BARRÉ or through an online form that must be filled in with the data required therein. The clients give their express consent to the use of their data for the purposes described in these terms and conditions. CASA BARRÉ will in no case commercialize with said data, nor will it provide them to third parties except for those service providers that necessarily collaborate with CASA BARRÉ in its exploitation such as banks or payment gateways.

Customers shall have full responsibility for the use of their customer account. Consequently, Customers are responsible for the proper custody and confidentiality of the user name and/or passwords that allow access to their account, and agree not to transfer their use to third parties, either temporarily or permanently, or to allow access to third parties.

By virtue of the foregoing, the Clients must immediately notify CASA BARRÉ through the following e-mail address [email protected] any improper use of their user name and/or password, due to circumstances such as theft, loss or unauthorized access to them, in order to proceed to their immediate cancellation. As long as such facts are not communicated, CASA BARRÉ will be exempted from any liability that may arise from the improper use of the User names or passwords by unauthorized third parties.

Clients of CASA BARRÉ may be clients of the physical Studios, of the Online Studio or of both at the same time. Being a client of one or the other does not imply being a client of all of them.

The platform of the physical studios and the database management software is the same platform and software as the app and online studio. In this way, it is the client who registers and manages their accounts and who processes and manages their deregistration in the database.

3.- User conduct on the Websites.

Customers agree to make a lawful, diligent, honest and correct use of any information or content accessed through the Websites, all under the principles of good faith and respecting at all times the law in force and these Terms and Conditions.

In particular but without limitation, users shall not:

I.Register or communicate data that is not true, accurate, complete and/or updated, or access the Websites using the name, identification data or password of another user or impersonate any person or identity.

II. Use the Websites for fraudulent purposes, or in connection with criminal offenses or unlawful activities of any kind.

III. Create a Profile or use the Websites to post, use or reuse any unlawful, offensive, pornographic, abusive, indecent, defamatory, obscene or threatening material of any kind, or that violates any copyright, trademark or confidentiality, privacy or any other right, or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, political advertising, chain letters, mass mailings or any other type of "spam", or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising content, chain letters, mass mailings or any other type of "spam" and, in general, any unnecessary annoyance or inconvenience.

iv. Download, send or otherwise distribute any content or applications that may violate any applicable law or infringe any rights of any party.

CASA BARRÉ reserves the right to deny any attempt to access the Websites, cancel accounts, delete or modify contents, or cancel the provision of Services in the cases in which there is an incorrect use of the Websites.

4. Conditions applicable to the purchase of individual classes, packages and monthly vouchers for classes offered in the Studios.

4.1 - Single classes and monthly packages.

It is possible to purchase, through the web, APP or in the Studios, trial classes, single classes or monthly packages which include packages of 5, 8, 12 and Unlimited, plus the online voucher. The payment corresponding to the purchase of the classes will be carried out according to the provisions of clause 7 of these Terms and Conditions.

The purchase of monthly packages, trial classes, online vouchers and single classes are non-refundable and non-transferable once purchased.

Clients who have purchased a class or package of classes may attend the sessions according to the voucher purchased, taking into account the schedule provided by CASA BARRÉ and the availability of places in each of the classes.

Notwithstanding the above, you must take into account that the packages purchased have an expiration date of 30 days from the date of your first reservation, the trial class and single class have a validity period of 30 days from the date of purchase.

CASA BARRÉ informs you that once the expiration date of the classes or packages has passed, they will no longer be valid and cannot be used to reserve a place nor will their amount be refunded. We remind you that both classes and packages are not transferable and the amount cannot be refunded once the purchase has been made.

The sessions and packages purchased will be added to the customer's account and will allow the customer to reserve a place in the classes. Each time a reservation is made, a class is deducted from the client's account.

Depending on the customer's choice, the monthly bonuses will be as follows:

I- Trial class 10€.

I- Single class 1 session per month, 20 €.

II- 5 sessions per month, 65 €.

III- 8 sessions per month, 90 €.

IV- 12 sessions per month, 110€.

V-Unlimited sessions per month, 125 €.

VI- Unlimited sessions per month plus unlimited online classes 140 €.

VII- Unlimited online sessions per month, 25 €.

Any purchase you make, whether it is a trial class, single class or any voucher, is valid for 30 days from the date of your first reservation.

CASA BARRÉ informs you that once this period has elapsed these will cease to be valid and cannot be used to reserve a place nor will their amount be refunded.

The CASA BARRE subscription includes all the material necessary for each class as well as the use of showers and towels.

4.2 - Recurring subscription bonds

Recurring subscription bonuses imply a monthly subscription and therefore a recurring payment of the agreed amount for each type of package that will be charged either on the last day of the previous month or on the first day of the current month for the enjoyment of that month's classes.

Recurring subscription vouchers grant the right to a certain number of sessions during the month according to the voucher purchased. In the event that the sessions are not used in the current month, there is no right to any refund or recovery of these sessions in subsequent months. The client has the right to use the voucher and it is the client's responsibility to reserve the classes in which he/she is interested, but we cannot guarantee that he/she will have a place in the classes he/she wants, as places are limited.

In order to make the monthly recurring payment for the subscription chosen by the customer, he/she must provide his/her credit/debit card details so that these packages can be charged directly to his/her card.

The client may request the cancellation of his monthly bonus or the modification of his monthly bonus for a lower or higher one at any time, taking effect for the following month as long as it has been communicated before the 20th day of the current month. Otherwise it will be effective for two months from now. Cancellations and modifications must always be made either in person at the Studio where the signature is requested or by sending an e-mail to the Studio address where the subscription was made.

5. Conditions applicable to the reservation of places in the classes offered by CASA BARRÉ in the Studios.

These conditions apply whether the reservation is made online or directly at the Studios.

Through the Website and APP in the same way as in person at the Studios, clients will be able to make reservations of places in the classes they wish to attend, depending on the schedule of hours on which CASA BARRÉ will provide information on the Website, in the APP and in the Studio, and on the availability of a place in each of the classes. CASA BARRÉ cannot guarantee the availability of space in the class desired by the client regardless of whether he/she has purchased a session or a package.

It is a prerequisite for booking classes that the client has registered as a client of CASA BARRÉ and therefore has accepted these Terms and Conditions and has at least one class purchased or a trial class. A class allows you to reserve a place.

The reservation and cancellation of classes is the sole responsibility of the Client.

Classes and site reservations are non-transferable and it is the responsibility of each Client not to allow anyone to use their account or impersonate them in the class.

In the event that the Client is unable to attend the class she has previously booked, she may cancel her reservation at no cost as long as she does so 5 hours prior to the start of the class. Once the class has been cancelled within the aforementioned period, it will be returned to the client's account so that she can book a future class. In no case will the amount of the class be refunded. If the class has not been cancelled or if the cancellation has been notified less than 5 hours before the start of the class, the class will be deducted from the Client's account for those who have a package of 5, 8 and 12 sessions. Customers with unlimited monthly vouchers will be charged a financial penalty of 4 euros.

In order to cancel the class:

- It can be done online, either through the web or the APP, by logging into the customer account and clicking cancel on the class reservation.

• Cancellations can be made in person at the Studio.
• Cancellation by social networks or other means will not be valid.
• It is the Customer's responsibility to cancel his/her reservation in time in order not to lose his/her credit.

- If there is no space available in the desired class, there is a possibility to join a Waiting List for that class by calling or emailing the Studio or directly on the website or app. To join the Waiting List it is necessary to have purchased classes in the account. If there is finally a place available, an automatic email will be generated with the confirmation of your place, in case the client does not want to attend the place assigned to him/her, he/she must proceed to cancel the reservation following the usual procedure.

Free seats will be assigned in order of enrollment to customers on the Waiting List. Once assigned and confirmed by the client if he/she does not wish to attend this assigned class, he/she must follow the same method established for site reservation cancellation.

The schedule of classes offered by CASA BARRÉ is subject to change. In the event that the Management decides to cancel a class in which a place has been reserved, the class will be returned to the client's account.

CASA BARRÉ reserves the right to substitute the instructor announced for a specific class without such substitution generating a right of refund of the class or amount to the Client.

In the case of customers with unlimited package do not cancel their reservations within the deadline or do not show up for class, they will have a penalty of 4 €. This will be automatically credited to your registered card.

6. Conditions applicable to the purchase of online subscriptions and online classes

6.1- Online Subscriptions and Monthly Packages

The CASA BARRÉ app offers through the page www.casabarre.com the possibility of purchasing a monthly bonus for an amount of 25€ per month that allows unlimited viewing of the so-called "VIDEOS" content.

A recurring subscription can also be made, with a monthly recurring charge of €25 on the credit card provided and following the same guidelines as in point 4.2 above.

At the moment the customer creates his account and makes the payment, he enjoys a period of 30 days from the date of purchase to view the content. The customer, with the online subscription, acquires the right and the possibility to view the ON DEMAND content of pre-recorded classes. From the moment he/she has the access possibilities, the service is considered provided by CASA BARRÉ regardless of whether the Client has made use of the service or not.

The subscription is personal and access sharing is not allowed. Two-factor systems are used to verify the authenticity of registered users.

7. Prices and method of payment.

These prices and forms of payment are applicable to the purchase of classes, to the purchase of packages made in the studios, to the purchase of online vouchers and to the purchase of physical products related to the CASA BARRÉ brand.

All prices of the services and products indicated on the Websites and in the studies are expressed in Euros and include VAT and any other taxes that may apply.

The customer must pay the corresponding amount through the payment procedures allowed on the Websites and/or in the studios.

In any of the options chosen by the users CASA BARRÉ will always send an email confirming the details of the purchase made and the corresponding invoice or receipt once the order has been formalized, that is to say, after the acceptance of these Terms and Conditions and the corresponding payment.

Users are guaranteed that the payment process is carried out with absolute security, in accordance with the required security protocols and services.

The client must notify CASA BARRÉ of any undue or fraudulent charge on the card used for the purchases, by sending an email to the studio where the subscription was made as soon as possible so that CASA BARRÉ can carry out the appropriate procedures. The price of the products and services may be modified at any time by CASA BARRÉ and in any case the client has the right not to continue buying or to cancel the corresponding subscription.

9.- Publication of comments and opinions on the Website and/or social media.

Comments and opinions made on the Websites and/or social media should not contain expressions that are not suitable for all audiences, nor should they incorporate indecorous content or content that is not considered appropriate or that hurts general sensibilities.

In particular, it will not be allowed:

i. Discriminatory publications: In no case shall publications that go against an individual and that violate the principles of the right to honor, personal and family privacy, self-image and personal dignity be allowed. Any type of discriminatory publication, whether for reasons of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance, is prohibited.

ii. Degrading content: Publications that are intimidating, threatening, degrading or in any way promote violence against a person or a specific group are not allowed.

iii. Advertising Content: It is not permitted to use the Web Site as a means to advertise, promote businesses, brands or personal items, or to obtain e-mail addresses to which unsolicited commercial communications may be sent.

iv. Content that promotes self-harm: All types of publications that promote the consumption of narcotic substances are prohibited, as well as those publications that are intended to incite eating disorders and self-harm.

CASA BARRÉ reserves the right to eliminate any comment and opinion that may incorporate some of the aforementioned contents. Likewise, CASA BARRÉ reserves the possibility of limiting the access of the user who has not complied with the provisions of this section.
